INFORMACJE DOTYCZĄCE DANYCH OSOBOWYCH
Informujemy, że administratorem danych osobowych jest
Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb z siedzibą w Krakowie ,ul. Deszczowa 2a,
adres do korespondencji: jw („Administrator”).
Od dnia 25.05.2018 r. będzie możliwość skontaktowania się z osobą odpowiedzialną za ochronę danych za pośrednictwem adresu: biuro@saw-trak.pl.
Dane osobowe będą przetwarzane przez Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb z siedzibą w Krakowie ul. Deszczowa 2a,
w szczególności:
1) na podstawie art. 6 ust. 1 lit. b) i lit. c) RODO* w celu:
a) podjęcia działań przed zawarciem umowy na żądanie osoby, której dane dotyczą lub wykonania umowy, której stroną jest osoba, której dane dotyczą (dane niezbędne do zawarcia umowy są wskazane na formularzu umowy)
b) wypełnienia obowiązku prawnego ciążącego na Administratorze;
2) na podstawie prawnie uzasadnionego interesu Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb z siedzibą w Krakowie ,ul. Deszczowa 2a,[tj. na podstawie art. 6 ust. 1 lit. f) RODO] w celu:
a) marketingu produktów lub usług własnych, w tym spersonalizowanych na podstawie profilu klienta
b) organizowania i przeprowadzania akcji marketingowych
c) dochodzenia lub zabezpieczenia roszczeń
d) prowadzenia analiz jakości technicznej świadczonych usług i urządzeń;
3) na podstawie odrębnej zgody [tj. na podstawie art. 6 ust. 1 lit. a) RODO] w celu:
a) dokonania weryfikacji wiarygodności płatniczej klienta w oparciu o informacje z biur informacji gospodarczej,
b) przekazywania klientowi informacji o proponowanych zmianach Umowy, w tym Regulaminu i Cennika, o zmianie nazwy (firmy), adresu lub siedziby, potwierdzenia przyjęcia reklamacji i udzielenia na nią odpowiedzi na wskazany adres poczty elektronicznej (e-mail)
c) marketingu bezpośredniego produktów lub usług firmy Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb z siedzibą w Krakowie ,ul. Deszczowa 2a
Marketing bezpośredni, o którym mowa za pomocą środków komunikacji elektronicznej (np. SMS, MMS, e-mail),
Odbiorcy danych osobowych
Będziemy przekazywać Państwa dane podmiotom, które działają na nasze zlecenie, tj. dostawcom usług i rozwiązań informatycznych, kurierom, podmiotom świadczącym usługi księgowe, finansowe, ubezpieczeniowe i administracyjne, organom publicznym, w tym sądom, na ich uzasadnione żądanie.
Okres, przez który dane osobowe będą przechowywane:
1) dane osobowe przetwarzane w celu zawarcia lub wykonania umowy oraz wypełnienia obowiązku prawnego Administratora będą przechowywane przez okres obowiązywania umowy, a po jego upływie przez okres niezbędny do:
a) posprzedażowej obsługi klientów (np. obsługi reklamacji)
b) zabezpieczenia lub dochodzenia ewentualnych roszczeń przysługujących firmie Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb z siedzibą w Krakowie ,ul. Deszczowa 2a
c) wypełnienia obowiązku prawnego Administratora (np. wynikającego z przepisów podatkowych lub rachunkowych);
2) dane osobowe przetwarzane na potrzeby marketingu produktów lub usług własnych firmy Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb z siedzibą w Krakowie ,ul. Deszczowa 2a. na podstawie uzasadnionego interesu prawnego, będą przetwarzane do czasu zgłoszenia sprzeciwu przez osobę, której dane dotyczą;
3) dane osobowe przetwarzane na podstawie odrębnej zgody będą przechowywane do czasu jej odwołania.
Prawa osoby, której dotyczą dane osobowe:
1) prawo dostępu do treści swoich danych osobowych, czyli prawo do uzyskania potwierdzenia czy Administrator przetwarza dane oraz informacji dotyczących takiego przetwarzania
2) prawo do sprostowania danych, jeżeli dane przetwarzane przez Administratora są nieprawidłowe lub niekompletne
3) prawo żądania od Administratora usunięcia danych
4) prawo żądania od Administratora ograniczenia przetwarzania danych
5) prawo wniesienia sprzeciwu wobec przetwarzania danych na podstawie uzasadnionego interesu Administratora lub wobec przetwarzania w celu marketingu bezpośredniego
6) prawo wniesienia skargi do polskiego organu nadzorczego lub organu nadzorczego innego państwa członkowskiego Unii Europejskiej, właściwego ze względu na miejsce zwykłego pobytu lub pracy osoby, której dane dotyczą lub ze względu na miejsce domniemanego naruszenia RODO
7) prawo do cofnięcia zgody w dowolnym momencie (bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem).

In connection with the fact that on 25th May 2018 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016 will come into force and apply to protection of natural persons with reference to personal data processing and to free flow of such, and repeal directive 95/46/EC (general data protection regulation), we are sending you information on personal data in the attachment.

Personal data are going to be processed by Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb with registered office in Krakow ul. Deszczowa 2a,
Pursuant especially to:
1) art. 6 para. 1 pt. b) and pt. c) of RODO* in order to:
a) undertake actions before entering into an agreement demanded by the person whom the data concern or performance of an agreement in which one party is the person whom the data concern (data necessary for conclusion of the agreement are indicated in the agreement form)
b) meet a legal obligation being a responsibility of the Administrator;
2) legitimate interest of Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb with registered office in Krakow, ul. Deszczowa 2a, [i.e. pursuant to art. 6 para. 1 pt. f) of RODO] in order to:
a) advertise own products and services, including specialised ones, based on the client profile
b) organise and undertake marketing activities
c) claim or secure claims
d) perform analyses of the technical quality of provided services and devices;
3) an independent agreement [i.e. Pursuant to art. 6 para. 1 pt. a) of RODO] in order to:
a) verify client creditworthiness based on information from economic information offices,
b) pass on to the client any information about proposed changes to the Agreement, including the Terms and Conditions and the Pricelist, a change of the company (firm) name or of the address or registered office, confirmation of admitting a complaint and responding to it at the specified electronic (e-mail) address
c) advertise directly the products or services of the Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb company with registered office in Cracow, ul. Deszczowa 2a
The direct marketing is conducted through electronic communication channel (e.g. SMS, MMS, e-mail).
Period of storage of personal data:
1) personal data processed in order to enter into or perform an agreement or meet a legal obligation of the Administrator shall be stored throughout the period of this agreement, and afterwards during the period necessary:
a) to provide after-sales service to customers (e.g. process a complaint)
b) for the Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb company with registered office in Cracow, u. Deszczowa 2a, to secure or claim potential damages to which it has the rights.
c) for the Administrator to meet a legal requirement (e.g. resulting from tax or accounting regulations);
2) personal data processed for the purposes of marketing of own products or services of the Przedsiębiorstwo Prywatne SAW-TRAK Paweł Zdyb company with registered office in Krakow, ul. Deszczowa 2a, on the basis of a legitimate legal interest, shall be processed until an objection is reported by the person whom the data concern;
3) personal data processed on the basis of an independent consent shall be stored until it is withdrawn.
Rights of the person whom the personal data concern:
1) right of access to the content of the personal data, i.e. the right to acquire confirmation as to whether the Administrator processes the data and as to the information about such processing.
2) right to correct the data, if the data processed by the Administrator are incorrect or incomplete
3) right to demand deletion of the data by the Administrator
4) right to demand restricting of the processing of the data by the Administrator
5) right to object to data processing based on the Administrator’s legitimate interest or to processing for the purposes of direct marketing
6) right to file a complaint with a Polish supervisory body or a supervisory body of another member state of the European Union having jurisdiction covering the place of habitual residence or work of the person whom the data concern or the place of a supposed breach of RODO
7) right to withdraw the consent at any given time (without relevance to compliance with the right to processing performed on the basis of the consent prior to its withdrawal).
